OTHER OFFENSES > Invasion of privacy.
Short Summary
This section of the Pennsylvania Compiled Statutes defines the offense of invasion of privacy. It prohibits certain actions done knowingly for the purpose of arousing or gratifying the sexual desire of another person. These actions include viewing, photographing, videotaping, or otherwise recording another person without their knowledge and consent while they are in a state of full or partial nudity and in a place where they would have a reasonable expectation of privacy. It also includes photographing, videotaping, or otherwise recording or personally viewing the intimate parts of another person without their knowledge and consent, when those intimate parts are not intended to be visible by normal public observation. Additionally, the section covers the transfer or transmission of images obtained in violation of the aforementioned actions. The section provides separate violations for each victim under the same or similar circumstances, and it specifies the grading of the offense based on the number of violations. The prosecution must be commenced within two years from the date of the offense, or within three years if the victim did not realize at the time that there was an offense. The section also includes exceptions for law enforcement officers during a lawful criminal investigation and for personnel of correctional facilities or during the investigation of alleged misconduct by a person in custody. The definitions of terms such as ‘full or partial nudity,’ ‘intimate part,’ ‘photographs or films,’ and ‘place where a person would have a reasonable expectation of privacy’ are provided in the section as well.
