GAMING COMMISSION - RACING (REVENUE) > Claiming rules.
Short Summary
The provided legal document outlines the claiming rules for the Gaming Commission - Racing (Revenue) in South Dakota. It applies to all persons who wish to make a claim in relation to horse racing. According to the rules, individuals must deposit the full amount of the claim in cash, unless they have an equal unencumbered amount of credit with the association. The claim must be made in writing on a form provided by the racing secretary and enclosed in a sealed envelope without any identification marks. The envelope must be marked with the number of the race and deposited in the claim box before all horses have left the paddock for the race. The paddock judge will open the claim box after all horses have left the paddock and deliver any claims to the stewards. A claimed horse may not be delivered by the original owner to the successful claimant until authorization is given by the stewards. Each claimed horse must run in the interest and for the account of the owner who entered it in the race, but the successful claimant becomes the owner of the claimed horse, whatever its condition, from the time the horse enters the track for the post parade. Claims made which are not in keeping with this chapter are voidable by the steward. A licensed owner or a licensed authorized agent for the account of an owner may claim horses whether or not the owner has horses at the meeting. If a claimed horse is excused by the stewards before the horse leaves the paddock for the post, any claim for the horse is void. When a stable consists of horses owned by more than one owner, but trained by the same trainer, not more than one claim may be entered on behalf of the stable in any one race. In case such an act inadvertently occurs, the owners shall compete by lot for the right to claim. The owners are not eligible to claim from that trainer’s stable. The claiming price of each horse in a claiming race shall be printed on the program, and all claims for the horse shall be for the amount stated. If more than one claim is filed for the same horse, the disposition of the horse shall be determined by lot under the direction of one or more of the stewards. When a horse is claimed, the successful claimant shall register the change of ownership with the racing secretary. The engagements of a horse claimed out of a claiming race pass with the horse to the claimant. The stewards shall open the claim envelopes for each race immediately upon receiving the envelopes from the paddock judge. No trainer, even though he is an owner and qualified under the rules to claim, may submit a claim out of the same race in which the owner of horses trained by him has submitted a claim. If such an act inadvertently occurs, the claim made by the trainer shall be declared void. No one may claim more than one horse out of any one race. No authorized agent, although representing more than one owner, may submit more than one claim in a race. If a claimed horse has had a posterior digital neurectomy and has not complied with requirements in 20:04:24:34, the claimant shall have 48 hours from the start of the race from which the horse was claimed to file a protest. The protest must be supported by an affidavit made by a licensed veterinarian and the official veterinarian.
