Can you summarize 44 CORS Article 30, Part 9?
COLORADO LIMITED GAMING ACT > CHARITABLE GAMING
Short Summary
The legal document governs limited gaming events sponsored by charitable organizations in Colorado. Charitable organizations must meet certain conditions, including entering into an agreement with a licensed operator or retailer. The agreement should provide for the payment of a flat fee or no fee to the retailer or operator. In return, the charitable organization will receive one hundred percent of the adjusted gross proceeds, less the amount of taxes due. The licensed operator or retailer is responsible for reporting and paying taxes on the full amount of the adjusted gross proceeds. A one-day sponsored event is defined as starting at 8 a.m. and ending at 8 a.m. the following day. Retailers are limited to allowing a single charitable organization to sponsor up to three days of limited gaming in a calendar year, and no more than thirty total days of sponsored events on their premises in a calendar year. Charitable organizations must file notice of their intent to sponsor limited gaming at least fourteen days in advance with the commission. This document was added to the Colorado Revised Statutes under the Charitable Gaming section in 2018. No person licensed as a retailer, operator, key employee, or support person, and no member, agent, employee, officer, or director of a charitable organization, shall represent to any person that a limited gaming activity is being sponsored by that or another charitable organization unless the sponsoring charitable organization has filed a notice of intent with the commission pursuant to section 44-30-902 (1)(e).
