Missouri has regulations in place to protect the privacy of computer-accessible, confidential personal information [3.1]. Agencies are required to develop policies and procedures to protect such information, maintain a current description of the information, and identify the statute that classifies the information as confidential. Additionally, a written agreement to protect the right to privacy of computer-accessible, confidential personal information must be signed before that information is provided by an agency to any other agency or private entity acting on behalf of an agency [3.1].
Regarding third-party project management tools that collect personal information, Missouri’s regulations on information exchange state that verbal or written information exchanges, prior to the release of the Request for Proposal (RFP) document, must be consistent with state and/or local procurement integrity requirements [2.1]. Information exchange may be used at different points after the release of the RFP document, but the commission will not engage in information exchanges that favor one proposer over another, reveal a proposer’s technical solution, reveal a proposer’s price without that proposer’s permission, reveal the names of individuals providing reference information about a proposer’s past performance, or knowingly furnish source selection information that could be in violation of Missouri procurement integrity standards applicable to the commission [2.1].
Based on the above regulations, it is recommended that any third-party project management tools used to collect personal information comply with Missouri’s regulations on the privacy of computer-accessible, confidential personal information and that any information exchange related to the use of such tools is consistent with state and/or local procurement integrity requirements [2.1][3.1].
