Can I skip updating my privacy policy and other CCPA-related documents in Missouri? What are the requirements?
Based on the Missouri Revised Statutes, all TNCs are required to adopt a privacy policy to protect the personal identifying information of TNC riders. The privacy policy shall include provisions regarding the disclosure of personal identifying information learned through a complaint or during the course of an investigation, be consistent with all applicable state and federal laws, and be submitted to the department as part of the application for a license [1.1]. Therefore, it is mandatory to update the privacy policy and other CCPA-related documents in Missouri.
Requirements for Updating Privacy Policy and Other CCPA-related Documents
The requirements for updating privacy policy and other CCPA-related documents in Missouri depend on the specific document. However, all documents must be consistent with all applicable state and federal laws. Here are the requirements for some of the documents:
- Privacy Policy: TNCs must adopt a privacy policy to protect the personal identifying information of TNC riders. The privacy policy shall include provisions regarding the disclosure of personal identifying information learned through a complaint or during the course of an investigation, be consistent with all applicable state and federal laws, and be submitted to the department as part of the application for a license [1.1].
- Minimum Energy Efficiency Standards: The department shall update the minimum energy efficiency standards in section 701.503 not less than once every three years beginning from the date the standards were first promulgated by rule. The purpose of any such update shall be to keep the state standards current with technological advancements and industry practices with regard to energy efficiency, while also giving due consideration to consumer and environmental costs and benefits. Standards shall not be more stringent than required by the federal energy star program requirements, if such requirements are applicable [1.3].
- Lactation Accommodations: Before July 1, 2022, the local board of education of each school district shall adopt a written policy that requires the administration of each public school building within the district to provide accommodations to lactating employees, teachers, and students to express breast milk, breast-feed a child, or address other needs relating to breast-feeding. The policy shall include provisions that require the district to provide a minimum of three opportunities during a school day, at intervals agreed upon by the district and the individual, to accommodate an employee’s, teacher’s, or student’s need to express breast milk or breast-feed a child. The policy shall include provisions that require such accommodations to be available to each lactating employee, teacher, or student for at least one year following the birth of the employee’s, teacher’s, or student’s child, and that permit such accommodations to be available for longer than one year as determined by each local school board [1.4].
- Reimbursement Insurance Policy: Reimbursement insurance policies insuring service contracts issued, sold or offered for sale in this state shall state that, upon failure of the provider to perform under the contract, including the failure to return the unearned provider fee, the insurer that issued the policy shall pay or perform according to the provider’s contractual obligations under the service contracts insured by the insurer [1.7].
- Group Long-Term Care Insurance Coverage: No group long-term care insurance coverage may be offered to a resident of this state under a group policy issued in another state to a group described in paragraph (d) of subdivision (4) of subsection 2 of section 376.1100, unless this state or another state having statutory and regulatory long-term care insurance requirements substantially similar to those adopted in this state has made a determination that such requirements have been met [1.8].
Therefore, it is important to review the specific requirements for each document and ensure that they are consistent with all applicable state and federal laws.
