No licensee or employee of any entity associated with the conduct of racing while on the grounds of a licensed or franchised racetrack shall have present within the licensee’s or employee’s system any controlled substance as defined in North Dakota Century Code chapter 19-03.1 or any prescription legend drug unless such prescription legend drug was obtained directly or pursuant to valid prescription or order from a duly licensed physician who is acting in the course of such physician’s professional practice. Acting with reasonable cause, the stewards or a designated commission representative may direct any such licensee or employee to deliver a specimen of urine in the presence of the track physician or subject the licensee or employee to the taking of a blood sample or other body fluids by a medically trained professional. In such cases, the stewards or the designated commission representative may prohibit such licensee or employee from participating in the day’s racing or until such time as such licensee or employee evidences a negative test result [1.5].
