Can I collect location information from participants in Delaware? What are the requirements?
Collecting Location Information from Participants in Delaware
In Delaware, geospatial data and information created by or for any state, county or local agency, or by or for any other organizations receiving state funds in whole or in part for the development of such data, shall be considered to be in the public domain, except as provided for in all applicable federal, state and local laws and statutes including the information security and data classification standards promulgated by the Delaware Department of Technology and Information [2.1].
Regarding missing child reports, any parent, guardian or legal custodian may submit a missing child report to a local law-enforcement agency having jurisdiction for investigation and referral of the missing child report to the Clearinghouse on any child whose whereabouts is unknown, regardless of the circumstances, which shall be included in the Clearinghouse database. The parent, guardian or legal custodian responsible for notifying the Clearinghouse or a law-enforcement agency of a missing child shall immediately notify such agency or the Clearinghouse of any child whose location has been determined [4.1].
Based on the above information, it is unclear what type of location information you are trying to collect from participants. If you are collecting location information for missing child reports, you may do so as described above. However, if you are collecting location information for other purposes, you may need to consult with legal counsel to ensure compliance with applicable laws and regulations.
