Can I avoid tracking unique users or website visitors in Utah? What are the requirements?
To avoid tracking unique users or website visitors in Utah, you must comply with the requirements set forth in the Utah Code and Utah Administrative Code.
If you operate a governmental website in Utah, you must comply with the requirements set forth in R895-8-6 and R895-8-7 of the Utah Administrative Code. These requirements include:
- Any personally identifiable information an individual provides to a State website shall be used solely by the State, its entities, and third party agents with whom it has contracted to perform a state function on its behalf [R895-8-6].
- If you collect personally identifiable information on your website, you must conspicuously post a notice that such information is subject to public access, if such information is public record [R895-8-7(1)(a)]. You must also post a notice and a summary or link to the citation of any State statute, federal statute, or federal regulation that supersedes part or all of this rule [R895-8-7(1)(b)]. Additionally, you must provide a link to your agency’s privacy policy [R895-8-7(1)(c)] and a link from your website to the Utah Administrative Code [R895-8-7(1)(d)] and the State Policy [R895-8-7(1)(e)].
- Your agency privacy policy must indicate the name of the issuing agency, a statement that the agency privacy policy applies to its own website only, a statement about what personally identifiable information the policy specifically applies to, and a statement defining how its agency privacy policy differs from this rule [R895-8-7(2)].
However, if you operate a court website, you cannot display personally identifiable information on the website, except as provided in Subsections (2) and (3) of UTCO 63D-2-104. This section does not prohibit access to any original document as provided by law.
If you comply with these requirements, you can avoid tracking unique users or website visitors in Utah.
