Connecticut law allows offering discounts or promotions to customers without violating pricing laws. However, there are certain requirements that must be met to avoid penalties.
According to Connecticut General Statutes (CGS) 42-133ff, no person may impose a surcharge on any transaction, but offering a discount on any transaction to induce payment by cash, check, debit card, or similar means rather than by charge card or credit card is allowed. To offer such a discount, the person must post a notice disclosing the discount. The notice must be clearly and conspicuously posted on the premises if the transactions are conducted in-person, displayed on the website or digital payment application before completing any online transaction or transaction processed by way of such digital payment application, and verbally provided before completing any oral transaction, including, but not limited to, any telephonic transaction [3.3].
Additionally, any provision in an agreement or contract that prohibits a gasoline distributor or retailer from offering a discount to a buyer based upon the method such buyer uses to pay for such gasoline is void and without effect because such provision is contrary to public policy [3.3].
If you are advertising the sale of untaxed alcoholic beverages for use in Connecticut, any written advertisement in this state for the sale of untaxed alcoholic beverages for use and consumption in this state shall contain the following words in not less than fourteen point reverse type in block form: “These alcoholic beverages are subject to the payment of the Connecticut alcoholic beverages use tax and the Connecticut use tax and may be subject to seizure as contraband goods.” In the case of any such advertisement being announced verbally, such announcement shall be immediately followed by the words above enclosed in quotation marks. Any person engaged in the business of selling alcoholic beverages, whether or not issued a license by the commissioner under the provisions of this chapter, violating the provisions of this section shall be fined five hundred dollars for each offense [2.1].
