Can I offer contests that involve VIP programs in Iowa? What are the requirements?
Based on the information provided in the context documents, it appears that offering contests that involve VIP programs in Iowa may require a license from the Iowa Racing and Gaming Commission. Specifically, a fantasy sports contest service provider must be licensed by the commission to offer an internet fantasy sports contest under Iowa Code chapter 99E [2.1].
To obtain a license, an applicant must meet certain standards, including financial stability, business ability and experience, good character and reputation of the applicant as well as all directors, officers, partners, and employees and integrity of financial backers [2.1]. Additionally, the commission shall not grant a license to an applicant if there is substantial evidence that any of the following apply: (1) A license issued to the applicant to conduct internet fantasy sports contests in another jurisdiction has been revoked, or a request for a license to conduct internet fantasy sports contests in another jurisdiction has been denied, by an entity licensing persons to conduct such contests in that jurisdiction. (2) The applicant has not demonstrated financial responsibility sufficient to adequately meet the requirements of the enterprise proposed. (3) The applicant does not adequately disclose the true owners of the enterprise proposed. (4) The applicant has knowingly made a false statement of a material fact to the commission. (5) The applicant has failed to meet a monetary obligation in connection with conducting an internet fantasy sports contest. (6) The applicant is not of good repute and moral character or the applicant has pled guilty to, or has been convicted of, a felony. (7) Any member of the board of directors or governing body of the applicant is not 21 years of age or older [2.1].
In addition, there are certain requirements for entry validation and price for drawings or contests that must be followed [1.2][1.3].
Therefore, it is recommended that you contact the Iowa Racing and Gaming Commission to determine the specific requirements for offering contests that involve VIP programs in Iowa.
