Can I offer contests that involve VIP programs in Arizona? What are the requirements?
Based on the provided context documents, there are no specific regulations that prohibit offering contests that involve VIP programs in Arizona. However, there are requirements that must be followed by fantasy sports contest operators and concessionaires offering prizes in Arizona.
Fantasy Sports Contests
Fantasy sports contests in the State, except those which are permitted pursuant to A.R.S. Title 13, Chapter 33, shall only be conducted by licensed responsible parties who operate in compliance with, and meet the terms of, the Act and this Article [2.1]. A person may not offer fantasy sports contests in this state unless the person is licensed by the department as a fantasy sports contest operator [3.2]. Fantasy sports contest operators must report any change to the information regarding ownership included in its application with the department within thirty days after the change is effective [3.1]. Eligibility to win a prize is based on compliance with the designated promotion playstyle as defined in R19-3-1004. The Promotion Profile shall define any required level of participation to be eligible [5.1].
Concessionaires
Concessionaires are prohibited from awarding cash prizes and buying back prizes for cash or any combination of prizes, articles, tickets, numbers, or other medium of exchange, any prize won by a player at the Fair. They are also prohibited from offering certain merchandise prizes, such as weapons of any kind, fireworks of any kind, handcuffs or fingercuffs, melted glass bottles, items that are inconsistent with the state’s interest in providing entertainment for families and children, eyeglasses other than sunglasses, medicine or drugs of any kind, and fowl or animals, except goldfish [4.1]. A concessionaire with a valuable prize may request authorization from the Board to limit the number of valuable prizes any player may win to one prize from each game location during each day of the Fair [4.2].
Requirements
If the VIP program involves offering prizes, the operator must comply with the requirements mentioned above. Additionally, the fantasy sports contest platform shall be designed to ensure the integrity and confidentiality of all player communications, security and confidentiality of player data including personal and financial information, and the proper identification of the sender and receiver of all communications [2.3]. The responsible party shall submit a catalogue of the events and fantasy sports contests it intends to offer. The catalogue and any changes shall be submitted to the Department prior to implementation. The Department may prohibit a particular event or fantasy sports contest if it does not comply with A.R.S. § 5-1201(6) [2.2].
