Can I offer contests that involve international sports in Arizona? What are the requirements?
Based on the information provided in the context documents, it appears that offering contests that involve international sports in Arizona is permitted as long as the contests are conducted by licensed responsible parties who operate in compliance with, and meet the terms of, the Act and the Article [2.1].
To offer such contests, the responsible party must submit a catalogue of the events and fantasy sports contests it intends to offer to the Department prior to implementation [2.2]. The Department shall publish a list of authorized events and fantasy sports contests on its website [2.2]. The Department may prohibit a particular event or fantasy sports contest if it does not comply with A.R.S. § 5-1201(6) [2.2].
Additionally, the responsible party must comply with the requirements outlined in AZRS 5-1208, which include reporting any change to the information regarding ownership included in its application with the department within thirty days after the change is effective, retaining and maintaining all of the records required to be maintained under this chapter and the rules adopted under this chapter for at least three years after the date the record is created, and organizing all records in a manner that enables the licensed fantasy sports contest operator to provide the department with the records [1.2].
The fantasy sports contest platform must be designed to ensure the integrity and confidentiality of all player communications, security and confidentiality of player data including personal and financial information, and the proper identification of the sender and receiver of all communications [2.3]. The responsible party must notify the Department in writing prior to the installation of a fantasy sports contest platform that the platform meets the design requirements of R19-4-211(A) and the geofence requirements of R19-4-210(A) through (D) [2.3]. The responsible party must also notify the Department in writing prior to the installation of a fantasy sports contest platform, and annually thereafter, that the platform properly calculates entry fees and payouts [2.3].
If the fantasy sports contest platform is unable to accept a fantasy sports contest entry or validate a winning entry for more than two hours, the responsible party shall notify the Department as soon as practically possible [2.4].
Finally, it is important to note that this chapter does not prohibit a sports governing body on whose events the department has authorized wagering from entering into agreements with licensees in which the sports governing body may share in the amount bet from sports wagering on the events of the sports governing body [3.2].
In summary, to offer contests that involve international sports in Arizona, the responsible party must be licensed and comply with the requirements outlined in the Act and the Article, submit a catalogue of the events and fantasy sports contests it intends to offer to the Department prior to implementation, comply with the requirements outlined in AZRS 5-1208, ensure that the fantasy sports contest platform meets the design and geofence requirements, and notify the Department in writing prior to the installation of a fantasy sports contest platform that the platform meets the design requirements and properly calculates entry fees and payouts.
Therefore, it is possible to offer contests that involve international sports in Arizona, subject to compliance with the above requirements.
