Can I offer contests that involve free entry in Oregon? What are the requirements?
Yes, you can offer contests that involve free entry in Oregon. However, the specific requirements for such contests depend on the type of contest. Below are the requirements for different types of contests:
Contests with Prizes Valued at Less Than $10,000
Charitable, fraternal, or religious organizations that conduct raffles with handles of less than $10,000 in one calendar year are exempt from the licensing and reporting requirements for raffles under ORS 167.108 to 167.164 and 464.270 to 464.530 [4.1]. However, it is important to note that this exemption only applies to raffles and not to other types of contests.
Second Chance Drawings
The only valid method of entry for second chance drawings is electronic entry as described in ORAR 177-052-0030 [1.1]. The Lottery will not accept entries by mail, in person, or by other method. To submit a valid electronic entry, a person must successfully register as a member on a Lottery designated website or mobile app, agree to the terms and conditions, enter the required information for each drawing, attest that the person is within the state of Oregon at the time of entry, provide any additional information as required by the Lottery, and submit the electronic entry prior to the deadline for submission of entries for the second chance drawing [1.1]. Only one person per entry may submit an entry for a second chance drawing, and an entry with more than one name on the entry form is invalid [1.1]. The Lottery may establish additional terms and conditions and entry requirements for any second chance drawing [1.1].
Take Your Shot, Oregon! Game
To be eligible to win a prize in the Take Your Shot, Oregon! game, an individual must meet the requirements of ORAR 177-054-0040 [2.2]. For minors selected to win an education scholarship prize, such prize must be claimed by and awarded to the selected winner’s parent or guardian, and such parent or guardian must also meet the requirements of this rule [2.2]. The individual must be a resident of Oregon at the time the individual received a COVID-19 vaccination and, for county-specific drawings only, be a resident of the particular county at the time the individual received a COVID-19 vaccination [2.2]. The individual must be a natural person age 18 or older on June 27, 2021 or, for education scholarship drawings only, be age 12 to 17 on June 27, 2021 [2.2]. The individual must be confirmed by the Oregon Health Authority to have received at least one dose of a COVID-19 vaccine by June 27, 2021 [2.2]. If at any time the Lottery or the Oregon Health Authority determines that a person or entrant into a Take Your Shot, Oregon! drawing does not meet the requirements of this rule or other applicable law, or rule or the Take Your Shot, Oregon! terms and conditions, that person is disqualified and is ineligible for a prize [2.2].
Based on the documents provided, it is unclear whether there are specific requirements for contests with prizes valued at more than $10,000 that involve free entry. Therefore, it is recommended that you consult with a legal professional to determine the specific requirements for your contest.
