To offer contests that involve both skill and chance in Arizona, you need to register with the attorney general’s office and follow the requirements outlined in AZRS 13-3311. The registration should include the name and address of the person conducting the contest or event, the minimum dollar amount of all prizes to be awarded, the duration of the event, the statutory agent or person authorized to accept service of process in Arizona for the person conducting the contest or event, all rules governing the contest or event, including the rules applicable in case of a tie, and the name and description of the product and the established purchase price for the product. Within ten days following the award of all prizes in connection with an amusement gambling intellectual contest or event, the person conducting the contest or event shall file with the attorney general’s office the names and addresses of all persons who have won prizes in connection with the contest or event. For each amusement gambling intellectual contest or event held, the person conducting the event shall file with the attorney general’s office a sworn statement under oath that no increment has been added to the established purchase price for the product in connection with the gambling event [2.1].
If you want to offer fantasy sports contests, you need to be licensed by the department as a fantasy sports contest operator or meet the requirements outlined in AZRS 5-1202. An individual may offer one or more fantasy sports contests if the contests are not made available to the general public, each of the contests is limited to not more than fifteen total fantasy sports contest players, and the individual collects not more than $10,000 in total entry fees for all fantasy sports contests offered in a calendar year, at least ninety-five percent of which are awarded to the fantasy sports contest players [3.1].
If you have any changes to the information regarding ownership included in your application with the department, you should report it within thirty days after the change is effective. You should retain and maintain in a place secure from theft, loss, or destruction all of the records required to be maintained under this chapter and the rules adopted under this chapter for at least three years after the date the record is created. You should organize all records in a manner that enables you to provide the department with the records. Information obtained under this section is confidential and privileged and is not subject to disclosure as provided in title 39, chapter 1, article 2 [5.2].
If you want to install a fantasy sports contest platform, you should notify the Department in writing prior to the installation of a fantasy sports contest platform that the platform meets the design requirements of R19-4-211(A) and the geofence requirements of R19-4-210(A) through (D). You should also notify the Department in writing prior to the installation of a fantasy sports contest platform, and annually thereafter, that the platform properly calculates entry fees and payouts [3.3].
If a contest is cancelled or declared “no contest,” refunds shall be granted on valid wagers in accordance with AZAC Title 19, Chapter 2, Article 5, Section 10, R19-2-510 [2.1].
