Can I obtain a fantasy sports license in Oklahoma? What are the requirements?
To our knowledge, Oklahoma does not have a specific license for fantasy sports. However, if you are interested in becoming a manufacturer, distributor, or manufacturer/distributor of gaming machines or gaming machine components to racetrack gaming operator licensees, you must obtain a license from the Oklahoma Horse Racing Commission [1.1].
The Oklahoma Horse Racing Commission may refuse to issue a license or deny any license application on any grounds deemed reasonable by the Commission [4.1]. The application for an organization license to conduct a horse race meeting shall be made on a form prescribed and furnished by the Commission and shall include a search waiver. The application shall contain the information listed in Section 205.1 of Title 3A of the Oklahoma Statutes [3.2].
As there is no specific license for fantasy sports in Oklahoma, we recommend contacting the Oklahoma Horse Racing Commission for further information on licensing requirements.
Please note that the Oklahoma Horse Racing Commission may deny an application for any type of employee license for any reason that an application for a horse racing Occupation Gaming License may be denied [2.1]. Additionally, no Commission employee, or person licensed by the Commission as a Jockey, or person licensed by the Commission as a practicing Veterinarian, Racing Official, Assistant Starter or Official Veterinarian and his or her assistants, Jockey Room Custodian, or Valet shall be licensed also as a horse Owner [3.1].
The grounds for denial, refusal, suspension or revocation of license include, but are not limited to, being convicted of a felony in this State, any other state, or the United States of America; being convicted of violating any law regarding gambling or a controlled dangerous substance of this State, any other state, or of the United States of America; being unqualified to perform the duties required of the applicant; failing to disclose or stating falsely any information required in the application; being found guilty of a violation of any provision of the Oklahoma Horse Racing Act or of the Rules and Regulations of the Commission; having a license or spouse’s license for any racing occupation or activity requiring a license suspended, revoked, refused or denied for just cause in any recognized racing jurisdiction; being excluded from any racing enclosure by a recognized racing jurisdiction; or having conduct or reputation that is such that his/her presence at a race meeting may, in the opinion of the Commission or the Stewards, reflect on the honesty and integrity of horse racing or interfere with the orderly conduct of a race meeting [3.3].

If you are interested in obtaining a Key Executive License or Gaming Employee License, you must submit a complete application with your fingerprints in duplicate on fingerprint cards and your photograph in duplicate. The fingerprints will not be accepted unless the fingerprints were taken under the supervision of, and certified by, Commission licensing personnel, a federal agency, a State police officer, a county sheriff, a municipal chief of police, or sworn city or county peace officer. The photographs must be no smaller than 3" x 2" and must be satisfactory to the Commission. The photographs also must have been taken no earlier than three months before the date the application for license was filed [2.2].
Applicants for a Key Executive License or Gaming Employee License who provide the required fingerprint cards, photographs, completed application, and intent to employ statement may be issued by the Executive Director a written certification that their applications for a Key Executive License or Gaming Employee License are presently being processed. Upon the issuance of such certification to an applicant for a Key Executive License or a Gaming Employee License, the applicant may for a period of no more than 90 days be employed as a Gaming Employee by the Racetrack Gaming Operator Licensee whose name appears on the applicant’s intent to employ statement [2.3].
