Prosecuting attorneys can bring an action to recover the civil penalty, or the cardholder can file the action if the prosecuting attorney does not do so within 60 days of the violation being reported. The penalties provided in this section are in addition to any other remedy available to the cardholder. Any civil penalty imposed is deposited in the state general fund, and attorney’s fees are awarded to the party successfully bringing the action.
