Identity Theft > Consumer requested security freeze on credit report; timing; notifications; temporary lifting of freeze; application; penalty.
Short Summary
This legal document governs the process of placing a security freeze on a consumer’s credit report. Consumers can request a security freeze by writing to a consumer credit reporting agency. The agency must make available an internet-based method and a toll-free telephone number for consumers to request a security freeze, temporarily lift a freeze, or remove a freeze. Once a security freeze is in place, the agency is prohibited from releasing the consumer’s credit report without the consumer’s authorization. The agency must place the security freeze within three business days of receiving the written request. They must also provide a written confirmation of the freeze within ten business days, along with a unique personal identification number or password for future authorization. If the consumer wants to temporarily lift the freeze, they must contact the agency, provide proper identification, the unique personal identification number or password, information about the time period for access, and any required payment. The agency must develop procedures to receive and process such requests. They must comply with the request within three business days of receiving a written request or within 15 minutes if received by telephone or electronically during normal business hours. There are exceptions to the security freeze, such as certain entities and purposes listed in subsection (m). Failure to comply with this document may result in a fine of up to $100.00 per violation.
