Short Summary
This Code section governs the placement and removal of security freezes for protected consumers by consumer credit reporting agencies. It requires consumer credit reporting agencies to place a security freeze for a protected consumer if requested by the protected consumer’s representative, provided that sufficient proof of identification and authority is provided. The consumer credit reporting agency must create a record for the protected consumer if no file exists. Once a security freeze is in place, the consumer credit reporting agency is prohibited from releasing the protected consumer’s credit report or any information derived from it. The security freeze remains in effect until it is removed by the protected consumer or their representative. The consumer credit reporting agency must remove the security freeze within 30 days of receiving a valid removal request. There is no fee for the services performed under this Code section. The Code section does not apply to certain uses of a protected consumer’s credit report or record, and a security freeze may be removed or a record deleted if based on a material misrepresentation of fact. Violations of this Code section may result in fines.

This Code section shall not apply to the use of a protected consumers credit report or record by: (1) A person administering a credit file monitoring subscription service to which the protected consumer has subscribed or the representative of the protected consumer has subscribed on behalf of the protected consumer; (2) A person providing the protected consumer or the protected consumers representative with a copy of the protected consumers credit report on request of the protected consumer or the protected consumers representative; or (3) A person or entity listed in subsection (m) or (o) of Code Section 10-1-914.

A person who violates this Code section may be fined not more than $100.00 for a violation concerning a specific protected consumer.
